US Government Files Its Own Stay Motion
Dateline Resources Limited (ASX: DTR) notified the ASX on 28 September 2026 that the Federal Defendants in the National Parks Conservation Association case had filed a motion before the US District Court for the Central District of California. The motion, lodged on 25 September 2026 (US time), asks the court to suspend its 10 August 2026 preliminary injunction while the appeal is heard.
The latest filing is separate from the stay application previously submitted by Dateline and its wholly owned subsidiary, Colosseum Rare Metals, Inc. (CRM).
The Government argues it is likely to win on appeal. It says the District Court was wrong to rule that the "valid existing rights" savings clause in section 508 of the California Desert Protection Act does not cover an approved Plan of Operations. It also argues that the injunction causes irreparable harm to US national security and the public interest. The Government has asked the court to allow CRM to resume operations under its approved plan while any stay is in place.
Department of War Emphasises Strategic Significance
The filing is accompanied by a sworn declaration from Michael P. Cadenazzi, Assistant Secretary of War for Industrial Base Policy. He described the Colosseum site as a particularly attractive rare earth prospect because it sits close to the Mountain Pass Mine and MP Materials' processing facility.
The declaration also says continued rare earth exploration at Colosseum serves US economic and national security interests. It points to the country's heavy dependence on foreign sources of these critical minerals.
Hearing Set Before Judge Snyder
A stay pending appeal must normally be sought first from the court that issued the order. Both the Government's motion and Dateline's motion will therefore go before Judge Christina A. Snyder, who granted the injunction. The hearing is set for 26 October 2026.
If the District Court refuses the stay, Dateline and the Government can take their application to the US Court of Appeals for the Ninth Circuit. The National Parks Conservation Association, the plaintiff, has said it opposes the stay motions.
Appeal Already Underway
On 22 September 2026, the Federal Defendants and Dateline/CRM each filed a notice of appeal with the Ninth Circuit against the 10 August injunction. The appeal will proceed in that court regardless of how the stay motions are decided.
